By accessing this website or any other portion of the Site (as defined below), you are agreeing to these Terms of Use (as amended from time to time, the β€œTerms of Use”) between you (β€œyou” or β€œyour”) and RootstockCollective Foundation (β€œFoundation,” β€œwe,” β€œus,” or β€œour”). These Terms of Use apply to your access to, and use of, our websites and website-hosted user interface (the β€œInterface”) that may be used to interact with various products and services, including the dApp to easily interact with the RootstockCollective DAO smart contracts (the β€œProtocol”), and related content and functionality through our website located at www.rootstockcollective.xyz and any other website operated by the Foundation on which these Terms of Use are posted (collectively, the β€œSite”) and through our related technologies (collectively with the Interface, Protocol and Site, including all existing and any updated or new features, functionality and technology, the β€œService”).

All access and use of the Service is subject to the terms and conditions contained in these Terms of Use. By accessing, browsing, or otherwise using the Site, the Interface, or any other aspect of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you are using the Service on behalf of an entity or other organization, you are agreeing to these Terms of Use for that entity or organization and representing to the Foundation that you have the authority to bind that entity or organization to these Terms of Use (and, in which case, the terms β€œyou” and β€œyour” will refer to that entity or organization). If you do not accept the terms and conditions of these Terms of Use, you will not access, browse or otherwise use the Service.

We reserve the right, at our sole discretion, to change or modify any portion of these Terms of Use at any time. You may read a current, effective copy of these Terms of Use by visiting the β€œTerms of Use” link on the Site. Your continued use of the Service from and after the date any such changes become effective constitutes your acceptance of the new Terms of Use. You should periodically visit this page to review the current Terms of Use so you are aware of any revisions. If you do not agree to abide by these or any future Terms of Use, you will not access, browse, or use (or continue to access, browse, or use) the Service. Without limiting anything set forth elsewhere in these Terms of Use, you agree that we shall not be liable to you or any third party as a result of any losses suffered by any modification or amendment of this Agreement.

PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

Your Privacy: For more information regarding our collection, use and disclosure of personal data and certain other data, please see our Privacy Policy (the β€œPrivacy Policy”). By using the Service, you consent to our collection, use and disclosure of Personal Data and other data as outlined therein. The Privacy Policy is hereby incorporated by reference into these Terms of Use.

Additional Terms: In addition, when using certain features through the Service, you will be subject to any additional terms applicable to such features that may be posted on or within the Service from time to time. All such terms are hereby incorporated by reference into these Terms of Use.

  1. Access and Use of the Service

1.1. Legal Compliance: You represent that you are at least 18 years old and your access and use of the Service will fully comply with all applicable laws and regulations, and that you will not access or use the Service to conduct, promote, or otherwise facilitate any illegal activity.

For the avoidance of doubt, you will comply with all applicable sanctions laws, regulations and rules in any applicable jurisdictions. The Services may not be used: (i) in the United States of America, South Sudan, Iran, Syria, North Korea, Myanmar, Democratic Republic of the Congo, Mali, Burkina Faso, Yemen, Haiti, Russia and Ukraine territories occupied by Russia (the β€œProhibited Jurisdictions”); (ii) by or for the specific benefit of any individual or entity resident of the Prohibited Jurisdictions, (iii) any entity 50% or more owned in the aggregate by any such person resident of the Prohibited Jurisdictions; or (v) for any other use requiring a license or other governmental approval. If the Foundation determines that you have breached your obligation under this section, we shall block your access to the Service and any interests in property as required by law, if continued Service could result in the Foundation being in violation, or subject to negative consequences, under the Sanctions Rules.

1.2. Permitted Use: The Interface and Site are provided solely for informational purposes and to access the Services, including without limitation a gateway to the dApp. You may not use the Services for any unlawful or prohibited activities. Unauthorized use of the Services, including unauthorized access to our systems, is strictly prohibited.

1.3 Interface Access and Use: The Interface allows you to interact with various DAO smart contracts on the Rootstock blockchain. By using the Interface, you acknowledge and agree that any transaction executed by you will be executed on the blockchain and cannot be reversed. You are solely responsible for your interactions with the smart contracts, including any losses or gains resulting from such interactions.

Smart contracts are autonomous, self-executing programs on the blockchain. By interacting with smart contracts, you understand and accept the risks associated with blockchain technology, including but not limited to potential bugs, security vulnerabilities, and the irreversibility of transactions. The Foundation does not control or guarantee the outcomes of the smart contracts.
